28 Undertaking initial customer due diligence

(1) A reporting entity must not commence to provide a designated service to a customer if the reporting entity has not established on reasonable grounds each of the matters in subsection (2) in relation to the customer.

(2) The matters are as follows:

  1. (a) the identity of the customer;
  2. (d) if the customer is not an individual—the identity of any beneficial owners of the customer;
  3. (e) whether the customer, any beneficial owner of the customer, [...] is: (i) a politically exposed person; or (ii) a person designated for targeted financial sanctions;

Questions firms ask first

Does Tranche 2 apply to my practice?

If you provide designated services, which covers most accounting, legal, conveyancing and real estate work, you are a reporting entity. When you add a piece of work, Intentiv shows whether it is in scope and why.

Do I need a compliance officer?

Yes. Every reporting entity must appoint an AML/CTF compliance officer at management level. It does not need to be a new hire. A partner, principal or practice manager can hold the role, and Intentiv is built so they can run the program without a compliance team.

Does Intentiv take on my obligations?

No. It helps you meet them and keeps the record. Responsibility stays with your firm. Intentiv is not endorsed by or affiliated with AUSTRAC.

Does the AI make decisions?

No. AI reads an uploaded ASIC company extract to find shareholders when the register returns none, and what it read is labelled as AI. A person makes every decision.

What does it cost?
